Claims for wrongful death are extremely complicated. Generally, they require that a probate be established, that all heirs be advised of the claim, which adds an extra element to the litigation process.

 

The law regarding who is entitled to bring a claim for wrongful death is gray, at best. Parents who are not dependent upon their adult children for care are generally not entitled to bring an action and vise versa. The deaths of adult children are difficult to pursue.
